LICENSED APPLICATION END USER LICENSE AGREEMENT (EULA)

This Licensed Application End User License Agreement (“Standard EULA”) governs your use of the “KATABA KIDZ” mobile application (“Licensed Application”). This Standard EULA is between you and KATABA KIDZ (“Licensor”) and not with Apple Inc. or any third-party app store provider. By downloading or using the Licensed Application, you agree to be bound by the terms of this Standard EULA.

Information We Collect :

  • a. Scope of License: Licensor grants you a nontransferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules. The terms of this Standard EULA will govern any content, materials, or services accessible from or purchased within the Licensed Application, including any updates provided by Licensor that replace or supplement the original Licensed Application. You may not distribute the Licensed Application over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute, or sublicense the Licensed Application, and if you sell your Apple device to a third party, you must remove the Licensed Application from the device before doing so. You may not copy, reverse-engineer, disassemble, modify, or create derivative works of the Licensed Application or any part thereof, except to the extent permitted by applicable law or the licensing terms governing use of any open-source components included with the Licensed Application.
  • b. Consent to Use of Data: You agree that Licensor may collect and use technical data and related information, including but not limited to information about your device, system, and application software, to facilitate the provision of software updates, product support, and other services related to the Licensed Application. Licensor may use this information to improve its products or provide services or technologies to you, provided it does not personally identify you.
  • c. Termination: This Standard EULA is effective until terminated. Your rights under this Standard EULA will terminate automatically if you fail to comply with any of its terms.
  • d. External Services: The Licensed Application may enable access to external services and websites ("External Services"). You agree to use External Services at your sole risk and acknowledge that Licensor is not responsible for the content or accuracy of any third-party External Services. You agree to comply with the terms of this Standard EULA when using External Services and acknowledge that Licensor is not liable for any misuse of External Services.
  • e. NO WARRANTY: You acknowledge that your use of the Licensed Application is at your sole risk. The Licensed Application and any services provided are provided "as is" and "as available," with all faults, and without warranty of any kind. Licensor disclaims all warranties and conditions with respect to the Licensed Application, either express, implied, or statutory, including but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement.
  • f. Limitation of Liability: To the extent permitted by law, Licensor shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Licensed Application, including but not limited to damages for loss of profits, loss of data, or business interruption. In no event shall Licensor's total liability to you for all damages exceed the amount paid by you for the Licensed Application.
  • g. Governing Law: This Standard EULA shall be governed by and construed in accordance with the laws of France, excluding its conflicts of law provisions. Any dispute arising from or relating to this Standard EULA shall be subject to the exclusive jurisdiction of the courts of France. By downloading or using the "KATABA KIDZ" mobile application, you acknowledge that you have read, understood, and agree to be bound by the terms of this Standard EULA. If you do not agree to the terms of this Standard EULA, do not download or use the Licensed Application.
